Notes ORDER. The 42 motion to dismiss is GRANTED in part and DENIED in part for the reasons set forth in the attached. Farmington-Girard's federal claims are ripe. All claims against defendant Planning & Zoning Commission are DISMISSED, and the Clerk is directed to terminate the Planning & Zoning Commission as a defendant. On Count I, Farmington-Girard has adequately pleaded its § 1983 claim based on the Bill of Attainder Clause against the City of Hartford; its § 1983 claim based on substantive and procedural due process, Equal Protection, and Contracts Clause violations are DISMISSED for failure to state a claim. The MunicipalDefendants did not move to dismiss Farmington-Girard's takings claim, which therefore also survives against the City of Hartford. Farmington-Girard has adequately stated claims for inverse condemnation (Count II) and municipal estoppel (Count III) against the City of Hartford.
